Covering letter from the Attorney General of the Armed Forces of Afghanistan, Yar Mohammad Tamkin, to the Attorney General, Mahmoud Daqiq. This was sent to the Attorney General along with a copy of the final report by military prosecutors into the case of the detainees in Gardez
Partial translation:
"Currently, there are two issues regarding the above-mentioned incident that seem to be important:
- Determining the fate of the seven suspects that are currently in custody. According to the documents in the file, there is no [supporting evidence] regarding their arrest.
- There is a strong possibility that an individual by the name of Jamal, son of Ghazi, has been murdered as a result of torture by allied forces during his interrogation. This matter can be pursued legally.
Considering the above-mentioned incident and the fourteenth amendment of the Penal Code of Afghanistan, it is necessary for our legal system to investigate the torture of the seven individuals and the murder of Jamal, son of Ghazi, and other similar acts committed by foreign nationals.
I seek your guidance regarding the two issues mentioned above."
