Independent reports later find that there were serious violations
of humanitarian law, but find no evidence of a "massacre."

The
New York Times reports that the US government is considering the announcement
of a new legal doctrine that would allow it to charge members of al-Qaeda
with conspiracy to commit war crimes, in the absence of any evidence
that they had actually engaged in criminal acts. Perhaps because of
the negative reaction generated by the report, the doctrine was not
subsequently announced.
